Permission to Acquire Visa Status

If you are obtaining (or are planning to apply for) the following visa status, you may invite (or bring) your spouse or children to Japan under Dependent (家族滞在: Kazoku Taizai) visa status to reside together in Japan and to support them financially during the period of your stay in Japan;

Definition of “spouse” and “child” for Dependent visa status

  • Spouse: those who is legally registered as a spouse (common-law spouse, deceased or divorced spouse and same-sex spouse are not included).
  • Child: legitimate child, illegitimate but acknowledged child, child adopted by supporter.

The Immigration Office grants your spouse and children Dependent visa status with a specific period of stay depending on your (supporter’s) financial capability, relationship to the applicant and other situation.

Those who hold Dependent visa status may not work and earn money in Japan, however, they may engage in a part-time job within the limitation of the permission if they obtain Permission to Engage in Other Activity (Shikakugai-katsudou Kyoka).

BASIC REQUIREMENTS for Dependent

Regardless of which visa status you will apply for, you need to satisfy the criteria first.

You need to be applicable to (1) – (4) below.

1. SUPPORTER’S VISA STATUS

  • The applicant’s supporter (spouse or parent of the applicant) must be applicable to under the following visa status:
    Professor|Artist|Religious Activities|Journalist|Highly Skilled Professional|Business Manager|Legal / Accounting Services|Medical Services|Researcher|Instructor|Engineer / Specialist in Humanities / International Services|Intra-Company Transferee|Care Worker|Entertainer|Skilled Labor|Cultural Activities|Student (enrolling in university as a undergraduate or graduate etc.)
  • In case that the supporter obtains Student visa status:
    students enrolling in university 大学, (junior) collage 短期大学, graduate school 大学院, school/organization equivalent to university 大学に準ずる機関(航空大学校・防衛大学校など), special course in special vocational school 専修学校の専門課程, organization/school training to enroll in the Japanese university, technical college 高等専門学校(高専), night school of undergraduate or graduate studies 大学または大学院研究科への夜間通学, can be applicable. However, students enrolling in Japanese language school or other vocational school (日本語学校や専門学校) cannot be applicable to the supporter of Dependent visa status.

2. RELATIONSHIP between the APPLICANT and SUPPORTER

You can provide documents or certificates to certify the relationship between the applicant and you as the supporter.

3. SUPPORTER’S INTENTION TO SUPPORT the APPLICANT and his/her CAPABILITY OF SUPPORT

  • Supporter has intention to support the applicant and is capable enough of supporting the dependent financially.
  • In case that the applicant is supported by Cultural Activities or Student visa holder:
    it is important to clarify the supporter (Cultural Activities or Student visa holder) is capable of supporting living of the dependent in Japan by spending his/her own savings, grants or scholarship, or receiving money constantly from their parents. Income derived from the activity based on the Permission to Engage in Other Activity (Shikakugai Katsudou) can be considered as financial capability for living in Japan, however, the application for Dependent visa status will be denied if the supporter and/or Dependent visa holder has been working more than the limit of the Permission or has not been attending school enough to keep the Student or Cultural Activities visa status.

4. The APPLICANT IS RECEIVING LIVING SUPPORT from the SUPPORTER

  • The applicant has been residing together with the supporter (unless there is good reason for living separately) and receiving living support.
  • In case that the applicant is legal age, the reason why he/she needs support for living (e.g. sickness or attending school etc.) has to be proved.
  • The application for Dependent will be denied in case the applicant is considered as financially independent. It is possible that Dependent visa holder engages in a part-time job with the Permission (Shikakugai Katsudou), however, he/she cannot keep Dependent visa status if the income exceeds his/her supporter’s.

NOTE

  • In case that the child is your step-child (spouse’s child and you are not a biological parent of the child) and has not been adopted by you, the child is not applicable to Dependent – he/she must apply for Designated Activities (Exception) 特定活動(告示外).
  • Dependent visa status is not applicable to parents and sisters/brothers of the supporter. In case of a father or a mother who is over 70 years old already and has sickness which requires care of someone and he/she doesn’t have any relatives in his/her country, it would be possible to be applicable to Designated Activities (Exception) depending on the situation.
  • Dependent visa holders must lose the visa status without their supporter. If their supporter leaves Japan and loses the visa status, they cannot stay in Japan under Dependent visa status any more. He/she must leave Japan with his/her supporter or apply for different type of visa status if any.
  • In case a child which is applicable to Dependent visa status is born (e.g. child of non-Japanese parents residing in Japan), be sure to apply for Permission to Acquire Visa Status within 30 days after the date of birth.

PROCEDURES

In case you are currently residing outside Japan yet or you are staying in Japan as a temporary visitor:

In case you have been in Japan under specific status and holding Residence Card already:

BASIC REQUIRED DOCUMENTS

You are required to prepare documents which certify that the contents of the application are true and correct. Necessary documents are varied depending on the situation of each applicant and the host person, however, it shall be as follows:

(1)Application form
(2)Portrait Photo (H 4cm x W 3cm)
(3)COE application only: envelope with necessary stamps.
(4)Application for change only: the original of passport and Residence Card (在留カード).
(5)Either one of the following documents to certify the relationship between the applicant and the supporter;

  • Certificate of Family Register (Koseki Tohon 戸籍謄本)
  • Certificate of Acceptance of Marriage Report issued at the city/ward office in Japan (婚姻届受理証明書)
  • Marriage Certificate or equivalent certificate to prove legal marriage in each country (of the applicant and supporter).
  • Birth Certificate or equivalent certificate to prove birth of the applicant.

(6)Passport and Residence Card (在留カード) of the supporter; copy
(7)Documents to certify the supporter’s occupation and income:

  • In case that the supporter is a worker or a business owner;
    – Employment Certificate or Business License etc. which can certify occupation of the supporter.
    – Tax/income Certificate and Tax payment Certificate for individual inhabitant tax (住民税の課税・所得証明書および納税証明書)
  • In case that the supporter is not working:
    – Bank Certificate for deposit etc. of the supporter’s bank account, Certificate of Grant/Scholarship etc.
    – Any documents to certify the financial capability to make living in Japan.

NOTE

  • Any supporting documents to prove the eligibility for the visa status etc. should be provided based on the situation.
  • All the documents written in foreign languages need to attach translation into the Japanese language.
  • Additional documents may be required during the screening at the Immigration Office after submitting the application.
  • Any certificate of Japanese authorities (Tax/Income Certificate, Certificate of Residence, Certificate of Company Register etc.) has to be the one issued within 3 months before the date of application.

PERIOD OF STAY

Each visa status has the expiration date – you can stay in Japan under the visa status during the specific period stated on Residence Card issued by Immigration Office.

Period of stay shall be decided by Immigration Office depending on the applicant’s circumstance. It shall be considered based on the supporter’s period of stay in Japan and other situation.

In case you wish to extend the period of stay granted, you may apply for Extension of Period of Stay before the expiry date.
